Dcast Terms of Service

Welcome to Dcast! These Terms of Service ("Terms") govern your use of Dcast services, including but not limited to live streaming, video on demand, content hosting, and personal site customization (collectively referred to as the "Services"). By accessing or using any of our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.


1. Account Registration and Eligibility

1.1 Account Creation

To access and use certain features of our Services, you may be required to create an account. You must provide accurate and complete information during the registration process and keep your account information up to date.

1.2 Eligibility

You must be at least 13 years old to create an account and use our Services. If you are under 13, you may only use our Services with the consent and supervision of a parent or legal guardian.

1.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.


2. Use of Services

2.1 License to Use Services

Subject to these Terms, Dcast grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or commercial use, as permitted by your subscription plan.

2.2 Prohibited Activities

When using our Services, you agree not to:

(a) Violate any applicable laws, regulations, or third-party rights;

(b) Engage in any activity that could harm or interfere with the proper functioning of our Services or others' use of the Services;

(c) Circumvent, disable, or otherwise interfere with security features of the Services;

(d) Attempt to gain unauthorized access to our systems or accounts of other users;

(e) Use automated means to access our Services, except for search engine indexing purposes;

(f) Transmit any viruses, malware, or harmful code through the Services;

(g) Use the Services for any illegal, fraudulent, or harmful purpose;

(h) Violate any applicable guidelines or policies provided by Dcast;

(i) Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity;

(j) Collect or store personal information about other users without their consent;

(k) Use the Services to distribute, transmit, or display any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable according to applicable laws;

(l) Use subdomains or custom domains in a manner that infringes on third-party trademarks, copyrights, or other intellectual property rights;

(m) Use subdomains or custom domains that impersonate or mislead users about your identity or affiliation;

(n) Engage in any activity that violates our Community Guidelines;

(o) Deploy Dcast monetization features (checkout, tips, donations, subscriptions, or embedded paid players) via the API or embed tools on any domain you have not declared in your account, or in violation of the domain-declaration and acceptable-use obligations in our Creator Agreement and API Terms.


3. Content Ownership and Licenses

3.1 Your Content

You retain ownership of all content you upload, post, stream, or transmit through our Services ("Your Content"). By uploading Your Content, you grant Dcast a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, publicly perform, and display Your Content in connection with the Services, subject to our Privacy Policy.

3.2 Content Responsibility

You are the author and publisher of Your Content and are solely responsible for it. Dcast acts only as a neutral technology platform, hosting provider, and payment-facilitation intermediary; Dcast does not create, author, pre-screen, endorse, or adopt user content, and is not the publisher or seller of Your Content.

You represent and warrant that you own, or have obtained all rights, licenses, consents, and permissions necessary to, all of Your Content, and that Your Content — together with its upload, sale, streaming, or distribution through the Services — does not and will not infringe or violate any copyright, trademark, right of publicity or privacy, or any other right of any third party, nor violate any applicable law or the acceptable use policy of any payment processor used in connection with it. You may not upload, sell, or distribute any content owned by another person unless you have that person's express permission. As between you and Dcast, you bear sole responsibility and liability for Your Content, and you agree to indemnify Dcast against any claim arising from it (see Section 9).

3.3 Content Moderation

Dcast reserves the right, but assumes no obligation, to review, modify, restrict, or remove any content that violates these Terms or our Community Guidelines, or that any payment processor or law requires us to remove, at any time and without prior notice.

3.4 Copyright Complaints and DMCA Notice-and-Takedown

Dcast respects intellectual property rights and responds to clear notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512) and equivalent laws of other jurisdictions.

If you believe content on the Services infringes a copyright you own or control, send a written notice to our designated agent at [email protected] that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material and information reasonably sufficient to let us locate it (such as the URL); (d) your contact information; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Upon receipt of a valid notice, Dcast will expeditiously remove or disable access to the material. The affected creator may submit a counter-notice as permitted by the DMCA. Dcast maintains and enforces a policy of terminating, in appropriate circumstances, the accounts of creators who are repeat infringers.

3.5 Reporting and Trust & Safety

You can report content or conduct that may violate these Terms or our Community Guidelines — including illegal content, sexual or adult content, harassment, or copyright infringement — by emailing [email protected] or using our contact form, with a link and a description sufficient to locate it.

Dcast acts on a notice-and-response basis. Dcast reserves the right, but assumes no obligation, to monitor, pre-screen, or proactively review content, and does not conduct automated surveillance of private lessons, video calls, or private messages. Upon a credible report or notice, Dcast may remove content and warn, suspend, or terminate the responsible account. Nothing in these Terms makes Dcast the author or publisher of, or otherwise responsible for, content created by users.


4. Personal Site Customization (Subdomain/Custom Domain)

4.1 Subdomain and Custom Domain Services

Dcast offers the ability to customize your personal site with a subdomain (e.g., yoursite.dcast.pro) or custom domain (e.g., yoursite.com) for eligible subscription plans.

4.2 Eligibility

  • Subdomain services are available for STAR, PRO, and VIP plans
  • Custom domain services are available for PRO and VIP plans only
  • You must accept these Terms and our Creator Site Agreement before activation

4.3 Acceptable Use

When using subdomain or custom domain services, you agree to:

(a) Use the domain in compliance with all applicable laws and regulations;

(b) Not use the domain to impersonate or mislead users about your identity;

(c) Not use the domain in a manner that infringes on third-party intellectual property rights;

(d) Not use prohibited or reserved subdomain names (as defined in our system);

(e) Maintain appropriate content standards as outlined in our Community Guidelines;

(f) Accept full responsibility for all content published on your custom site.

4.4 Domain Verification

Dcast may require verification of your custom domain ownership and compliance with these Terms before activation. We reserve the right to suspend or terminate domain services if you violate these Terms.


5. Intellectual Property Rights

5.1 Intellectual Property

All intellectual property rights in the Services and Dcast content are owned by Dcast or its licensors. You agree not to remove, alter, or obscure any copyright, trademark, or other proprietary rights notices from the Services or Dcast content.

5.2 Feedback

If you provide Dcast with any feedback, suggestions, or ideas regarding the Services, you grant Dcast a non-exclusive, perpetual, irrevocable, royalty-free license to use, disclose, reproduce, modify, sublicense, and otherwise exploit the feedback without any compensation or obligation to you.


6. Suspension and Termination

6.1 Suspension

Dcast may suspend or terminate your access to the Services if we believe that you have violated these Terms or engaged in any unlawful, harmful, or abusive behavior. We will make reasonable efforts to notify you before taking any action, except in cases where immediate action is necessary for security reasons.

6.2 Termination

You may stop using our Services at any time. If you wish to terminate your account, please contact us at [email protected]. Please note that terminating your account will not affect the rights granted to Dcast under Section 3.

6.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. Dcast may delete your account and all associated content, including subdomain and custom domain configurations, without liability to you.


7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. DCAST DISCLAIMS ALL WARRANTIES FOR THE SUCCESSFUL DISTRIBUTION OF YOUR CONTENT, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. DCAST IS NOT RESPONSIBLE FOR THE LACK OF ACCESS TO CONTENT DUE TO INTERNET CONNECTION LOSS OR OTHER PROBLEMS (INTERNET PROVIDERS) OF THIRD PARTY ORGANIZATIONS PROVIDING INTERNET ACCESS SERVICES TO OUR CUSTOMERS, AS WELL AS THE SERVICES WILL BE UNINTERRUPTED AND WITHOUT ERROR OR HARMFUL COMPONENTS.


8. Limitation of Liability

IN NO EVENT SHALL DCAST, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICES.


9. Indemnification

You agree to indemnify, defend, and hold harmless Dcast, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.


10. Changes to Terms

Dcast reserves the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Services after such modifications constitutes your acceptance of the updated Terms.


11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.

Governing Language

These Terms are drafted in English, which is the governing and legally binding language. Any translation into another language is provided for convenience only; in the event of any conflict or discrepancy, the English version prevails. The sole exception is the Ukrainian-language Public Offer for payments via plata by mono (Monobank / АТ «Універсал Банк»), which is binding for those payments as required by Ukrainian law.
