PAYMENT TERMS AND CONDITIONS

1. OVERVIEW
These Payment Terms ("Terms") govern all payment transactions on the Dcast platform. By using our payment features, you agree to these Terms and all applicable financial regulations.
2. PAYMENT PROCESSING
2.1 Payment Gateway Integration
- All payments are processed through the creator's connected payout gateway (Stripe, PayPal, plata by mono (Monobank / АТ «Універсал Банк»), or cryptocurrency via NOWPayments); platform tariffs may be paid via any of these
- We are not a payment processor; the connected gateway handles all payment processing
- You must comply with the terms of service of the applicable payment gateway
- The gateway's fees are separate from our platform fees

2.2 Supported Payment Methods
- Credit and debit cards (Visa, Mastercard, American Express, Discover)
- Digital wallets (Apple Pay, Google Pay, PayPal)
- plata by mono (Monobank / АТ «Універсал Банк»), where available
- Bank transfers (where available)
- Cryptocurrency (via NOWPayments, where supported)
2.3 Currency and Exchange Rates
- Transactions are processed in USD or, where supported by the connected gateway, in the local currency (e.g., UAH for plata by mono)
- Currency conversion is handled by the connected payment gateway
- Exchange rates are determined by the connected gateway and may vary
- We do not control exchange rates or conversion fees
3. CREATOR PAYMENTS
3.1 Creator Payouts
- Stripe (Connect Standard): Funds from your sales settle directly into your own connected Stripe account. You control your own payout schedule, methods, minimums and currency through your Stripe dashboard, subject to Stripe's terms. Dcast does not hold your funds, set payout timing, or issue payouts for these sales; Dcast's commission is collected automatically as a Stripe application fee at the time of each charge.
- Other gateways (PayPal, plata by mono, cryptocurrency): payouts are governed by the connected gateway and its applicable offer/terms.
3.2 Payment Verification (KYC)
- All creators must complete the connected gateway's identity verification (KYC) before they can accept payments or receive payouts
- For Stripe, you complete Stripe's onboarding and identity/tax verification directly with Stripe; you can accept payments only once Stripe enables charges on your account
- Additional documentation may be required by the connected gateway
4. PLATFORM FEES
4.1 Fee Structure
- Platform Commission: a percentage of each creator sale that depends on the creator's plan — VIP 1%, PRO 3%, STAR 5%, FREE 7%; the maximum platform commission is 7%. It is collected automatically (as a Stripe application fee for Stripe, or as an agent commission for plata by mono).
- Payment Processing Fee: charged by the connected payment gateway, which varies by gateway:
- Stripe: 2.9% + $0.30 per transaction
- PayPal: 3.49% + $0.49 per transaction
- plata by mono (Monobank / АТ «Універсал Банк»): approximately 1.3–2%
- Cryptocurrency (via NOWPayments): approximately 0.5%
- International Fee: Additional 1.5% for international cards (where applied by the gateway)
- Currency Conversion Fee: 1% of transaction amount (where applied by the gateway)
4.2 Fee Calculation
- Fees are calculated on gross revenue before taxes
- Fees are deducted before payment to creator
- Refunds do not reduce platform fees
- Chargebacks may result in additional fees
4.3 Fee Changes
- We may change fees with 30 days notice
- Existing content pricing is grandfathered for 90 days
- New pricing applies to new content and subscriptions
- Fee changes are communicated via email and platform notifications
5. REFUNDS AND CHARGEBACKS
5.1 Refund Policy
- Refunds and cancellations are governed by our Refund & Cancellation Policy
- For creator sales, the creator is the seller of record and refund decisions are handled in accordance with that policy; Dcast facilitates the refund through the connected gateway
5.2 Chargeback Process
- Chargebacks are handled by the connected payment gateway (cryptocurrency transactions are generally irreversible and not subject to chargebacks)
- We may dispute chargebacks with evidence
- Chargeback fees are passed through to creators
- Excessive chargebacks may result in account suspension
5.3 Dispute Resolution
- Payment disputes are resolved through the connected payment gateway
- We provide evidence to support legitimate transactions
- Creators may be required to provide additional documentation

6. TAX OBLIGATIONS
6.1 Creator Tax Responsibilities
- As an independent seller, you are solely responsible for reporting and paying all taxes on your sales (income, sales tax, VAT/GST) in every applicable jurisdiction
- International creators must comply with their local tax laws
- Tax advice should be obtained from qualified professionals
6.2 Tax Reporting
- Where your sales are processed through Stripe Connect, any applicable tax forms (e.g., U.S. Form 1099-K) are issued by Stripe in respect of your own connected account and are available in your Stripe dashboard
- Dcast does not collect or remit taxes on behalf of creators and does not issue tax forms for creators' sales
- Dcast reports only its own commission/platform revenue as required by law
6.3 Value Added Tax (VAT)
- For creator sales, any VAT/GST obligations rest with the creator (the seller of record) and/or their connected payment gateway
- For Dcast's own platform fees and tariff charges, Dcast accounts for VAT where required by law
- VAT is included in displayed prices where applicable
7. INTERNATIONAL CONSIDERATIONS
7.1 Cross-Border Payments
- International payments may take longer to process
- Additional fees may apply for international transfers
- Currency conversion rates may vary
- Local banking regulations may affect payouts
7.2 Sanctions and Compliance
- We comply with international sanctions lists
- Payments to sanctioned individuals/entities are prohibited
- We may freeze accounts pending compliance review
- Legal compliance is required in all jurisdictions
7.3 Data Protection
- Payment data is protected according to PCI DSS standards
- International data transfers comply with applicable laws
- Personal information is handled according to our Privacy Policy
- Data retention policies vary by jurisdiction
8. SECURITY AND FRAUD PREVENTION
8.1 Security Measures
- All payments are encrypted and secure
- We monitor for fraudulent activity
- Suspicious transactions may be flagged for review
- Account verification helps prevent fraud
8.2 Fraud Prevention
- We may request additional verification for large transactions
- Unusual payment patterns may trigger security reviews
- We work with law enforcement on fraud cases
- False information may result in account termination
8.3 Account Security
- Use strong, unique passwords
- Enable two-factor authentication
- Monitor your account for unauthorized activity
- Report suspicious activity immediately
9. LIMITATIONS AND DISCLAIMERS
9.1 Service Availability
- Payment services may be temporarily unavailable
- We do not guarantee uninterrupted payment processing
- Technical issues may delay payments
- We are not responsible for third-party service outages
9.2 Limitation of Liability
- Our liability for payment issues is limited to the transaction amount
- We are not liable for indirect or consequential damages
- The liability limitations of the connected payment gateway also apply
- Some jurisdictions may not allow these limitations
9.3 Force Majeure
- We are not liable for payment delays due to circumstances beyond our control
- Natural disasters, government actions, or technical failures may affect payments
- We will work to resolve issues as quickly as possible
- Alternative payment methods may be offered when possible
10. TERMINATION AND SUSPENSION
10.1 Payment Suspension
- We may suspend payments for policy violations
- Account verification issues may delay payments
- Legal compliance issues may freeze accounts
- We will provide notice when reasonably possible
10.2 Account Termination
- Outstanding payments will be processed according to our schedule
- Refunds may be issued for unfulfilled obligations
- Account data will be retained according to our policies
- Legal obligations may require extended data retention

12. GOVERNING LAW
These Payment Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles.
13. MERCHANT OF RECORD & REQUISITES
Who you are paying depends on the payment method:
- International — Stripe:
- Platform subscriptions (Dcast tariffs — e.g. STAR/PRO/VIP): the merchant of record is PROFIGROUP LLC, 600 1st Ave, Ste 102 PMB 2397, Seattle, WA 98104, United States. © PROFIGROUP LLC.
- Creator content (subscriptions, pay-per-view, tickets, bookings, tips): the merchant of record is the individual creator, who is the independent seller for that sale. Dcast is not the seller of creator content; it provides the platform and facilitates the payment through Stripe Connect (Standard accounts, direct charges), retaining only its commission (an application fee). The creator completes Stripe's onboarding and is bound by the Stripe Services Agreement and the Stripe Connected Account Agreement directly with Stripe.
- International — PayPal and cryptocurrency (NOWPayments): for creator content the creator is the seller of record; for platform tariffs the merchant of record is PROFIGROUP LLC (address above). These Payment Terms, together with our Terms of Service, Refund & Cancellation Policy, Privacy Policy and, for crypto, the Crypto Payments & AML Policy, are the agreement you accept when you pay through these methods.
- Ukraine — plata by mono (Monobank / АТ «Універсал Банк»): the merchant of record is ФОП Ємельянов Дмитро Олексійович. The full Ukrainian-law requisites (tax ID, registered address and bank details) and the binding offer are in the Public Offer (Universal Bank).
