Developer / Partner API Terms

These Developer / Partner API Terms (the "API Terms") govern access to and use of the DCAST PRO application programming interface and related developer services (the "API"), provided by PROFIGROUP LLC ("Dcast", "we", "us") operating dcast.pro and api.dcast.pro. By generating an API key, calling the API, or otherwise using the developer services, you ("Partner", "you") agree to these API Terms.

These API Terms supplement and incorporate our Terms of Service, Privacy Policy, Payment Terms, Copyright Policy & DMCA, and Community Guidelines. If there is a direct conflict with respect to API use, these API Terms control.

1. Definitions

  • API — the DCAST PRO programming interfaces, endpoints, SDKs, documentation, and developer tools, with base URL https://api.dcast.pro/api/v1.
  • API Key / Credentials — the keys, tokens, and secrets issued to you to authenticate API calls.
  • Partner Application — your product, site, or service that integrates the API.
  • End User — any person or entity that accesses your Partner Application.
  • Partner Content — any content, data, video, or material you or your End Users transmit through, store with, or distribute using the API.

2. License and Resale

Subject to these API Terms and payment of applicable fees, Dcast grants you a non-exclusive, worldwide, revocable, non-transferable (except as stated below) license to access and use the API to build, operate, and offer your Partner Application.

Resale and sublicensing are permitted. You may integrate the API into your own products and resell, sublicense, or otherwise make the resulting functionality available to your End Users and third parties, provided that (a) you remain fully responsible for your End Users' use and compliance with these API Terms, (b) you do not expose raw API Keys to End Users, and (c) you do not present the API as your own original technology in a way that misrepresents Dcast.

3. API Keys and Security

You are responsible for all activity that occurs under your API Keys. You must keep Credentials confidential, not embed secret keys in client-side or publicly accessible code, and rotate or revoke Keys you believe are compromised. You must notify us promptly at [email protected] of any unauthorized use. Dcast is not liable for losses arising from your failure to secure your Credentials.

4. Acceptable Use and Restrictions

You will use the API in compliance with all applicable laws and our Terms of Service and Community Guidelines. You will not, and will not permit any End User to:

  • exceed, circumvent, or interfere with rate limits, quotas, or technical restrictions;
  • reverse engineer, decompile, or attempt to derive source code or non-public aspects of the API;
  • use the API to build a product that merely replicates the API itself to compete with Dcast as a standalone API;
  • transmit malware, conduct security testing without authorization, or disrupt the integrity or performance of the Services;
  • use the API for unlawful, infringing, or prohibited content, or in violation of the acceptable use policy of any payment processor.

Declared integration domains. If you integrate or embed Dcast monetization features — paid-content checkout, tips or donations, subscriptions, or embedded paid players — in any Partner Application via the API or embed tools, you must declare, in your Dcast account, every domain on which those features are deployed. Dcast restricts payment, donation, and subscription forms to your declared origins; they will not function on undeclared origins. Dcast may verify declared domains and may suspend monetization for any deployment that is undeclared, misrepresented, or otherwise non-compliant with these API Terms or our Community Guidelines. The prohibition on unlawful, infringing, and payment-restricted content (including pornographic or sexually explicit adult content and anything on a payment processor's restricted-business list) applies to all such deployments, whether on Dcast-hosted pages or on your own external or declared domains.

5. Rate Limits, Quotas, and Changes to the API

Dcast may set, modify, and enforce rate limits, quotas, and usage tiers, and may throttle, suspend, or limit access that, in our reasonable judgment, threatens the stability, security, or lawful operation of the Services. We may modify, add, deprecate, or discontinue any part of the API. Where a change is materially backward-incompatible, we will make commercially reasonable efforts to provide advance notice through the developer documentation or your account contact.

6. Partner Content, End Users, and Copyright

As between you and Dcast, you are solely responsible for Partner Content and for the acts and omissions of your End Users. You represent and warrant that you and your End Users own or have all rights, licenses, and permissions necessary for Partner Content and that it does not infringe any third party's rights or violate any law. Dcast acts only as a neutral technology and hosting intermediary and is not the author, publisher, or seller of Partner Content.

The notice-and-takedown and repeat-infringer process in our Copyright Policy & DMCA applies to Partner Content. You will implement a substantially equivalent process for your End Users and will promptly act on, and pass through to Dcast, valid takedown requests.

7. Data Protection — Independent Controllers

With respect to personal data of your End Users processed in connection with your Partner Application, each party acts as an independent data controller in its own right; this is not a processor/sub-processor or joint-controller arrangement. Each party is independently responsible for its own compliance with applicable data-protection and privacy laws, including providing its own privacy notice and lawful basis to its End Users. You will obtain all consents and provide all disclosures required for the personal data you transmit to or collect through the API.

8. Fees

Access to the API is provided under the plan and pricing you select (see Pricing). Billing, currency, refunds, and payment processing are governed by our Payment Terms. Non-payment may result in suspension or termination of API access.

9. Disclaimer of Warranties

THE API AND DEVELOPER SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. DCAST DOES NOT WARRANT THAT THE API WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECT WILL BE CORRECTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DCAST WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR BUSINESS, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE API. Dcast's aggregate liability for any claim relating to the API will not exceed the amounts you paid to Dcast for API access in the three (3) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Dcast and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from Partner Content, your Partner Application, your End Users, your resale or sublicensing of the API, or your violation of these API Terms or any third-party right.

12. Suspension and Termination

Dcast may suspend or terminate your API access, with or without notice, for breach of these API Terms, abuse, security or legal risk, or non-payment. You may stop using the API at any time. Upon termination, your license ends and you must cease use of and securely delete your Credentials. Sections that by their nature should survive (including Sections 6, 7, 9, 10, and 11) survive termination.

13. Governing Law and Other Terms

These API Terms are governed by, and disputes resolved under, the same governing law and dispute-resolution provisions as our Terms of Service. These API Terms, together with the documents they incorporate, are the entire agreement between you and Dcast regarding the API. We may update these API Terms by posting a new version at this address; continued use of the API after a change constitutes acceptance.
