This Creator Agreement for Monetization ("Agreement") is an integral part of Dcast's Terms of Service and governs your use of monetization features, including payout gateway integration, subscription tiers, and payment processing. By connecting a supported payout gateway (Stripe, PayPal, plata by mono (Monobank / АТ «Універсал Банк»), or cryptocurrency via NOWPayments) or enabling monetization features, you agree to be bound by this Agreement.

## 1. Eligibility and Acceptance
### 1.1 Eligibility - You must be at least 18 years old to use monetization features - You must connect a supported payout gateway (Stripe, PayPal, plata by mono (Monobank / АТ «Універсал Банк»), or cryptocurrency via NOWPayments) - You must comply with the terms of service of your connected payout gateway - You must accept Dcast's [Terms of Service](/legal/terms-of-service) and this Agreement
### 1.2 Acceptance Required Before enabling monetization features, you must:
(a) Read and understand this Agreement and our Terms of Service;
(b) Accept that you are solely responsible for all monetized content;
(c) Agree to comply with all applicable laws and regulations regarding payments and content sales;
(d) Confirm that you will not use monetization features for illegal, fraudulent, or harmful purposes;
(e) Acknowledge that Dcast may suspend or terminate your monetization features if you violate these terms.

## 2. Monetization Features
### 2.1 Payout Gateway Integration Dcast processes payments for your content through your connected payout gateway. Dcast supports Stripe (via Stripe Connect), PayPal, plata by mono (Monobank / АТ «Універсал Банк»), and cryptocurrency (via NOWPayments); Stripe Connect is one supported option, not the only one. By connecting a payout gateway, you agree to:
- Comply with the terms of service and policies of your connected payout gateway - Provide accurate information for the gateway's verification process - Maintain your gateway account in good standing - Accept responsibility for all transactions processed through your account - Authorize Dcast to share with that gateway the data described immediately below
By connecting a payout gateway (Stripe via Stripe Connect, PayPal, plata by mono, or cryptocurrency via NOWPayments), you authorize Dcast to disclose to that gateway certain data about you and your monetization activity that the gateway requires for onboarding, identity and business verification, risk assessment, and ongoing compliance — including your account and contact details, your Dcast creator page URL (`dcast.tv/creator/`), and every domain you have declared under Section 2.4 as a location where that gateway's payment instruments are deployed. This authorization extends only to the gateway(s) you choose to connect; Dcast does not disclose your data to a gateway you have not connected. Creators who do not connect a payout gateway — including those who only subscribe to a Dcast platform plan and do not sell content — are not subject to this disclosure.
### 2.2 Subscription Tiers You may create subscription tiers for your content, subject to:
- Your platform plan limits (STARTER: 3 tiers, PRO/VIP: 5 tiers) - Your connected payout gateway's account requirements - Dcast's platform fees and policies
### 2.3 Payment Processing All payments are processed through your connected payout gateway (Stripe, PayPal, plata by mono, or cryptocurrency via NOWPayments). Dcast:
- Collects only its commission as specified in your plan (as a Stripe application fee, or an agent commission for plata by mono) - Does not hold or custody your funds — your sale proceeds settle directly to your connected gateway account - Is not responsible for the gateway's payment processing or disputes
### 2.4 Integration and Embedding of Monetization Features If you integrate or embed Dcast monetization features — including paid-content checkout, tips and donations, subscriptions, or embedded paid players — on any website or application via the API or embed tools, you must declare, in your Dcast account, every domain on which those features are deployed. Dcast restricts payment, donation, and subscription forms to your declared domains; they will not function on undeclared origins. Dcast may verify declared domains, and may suspend monetization for any deployment that is undeclared, misrepresented, or otherwise non-compliant with this Agreement, our Community Guidelines, or the acceptable use policy of your connected payout gateway.

## 3. Content Responsibility
### 3.1 Monetized Content You are the author, publisher, and seller of all content you monetize, and you are solely responsible for it, including:
- Subscription tiers and pricing - Video content and descriptions - Promotional materials - Refund policies
Dcast acts solely as a neutral technology and payment-facilitation intermediary; it is not the author, publisher, or seller of your content. You represent and warrant that you own, or have obtained all rights, licenses, and permissions necessary to, all content you monetize, and that monetizing, streaming, and distributing it infringes no copyright, trademark, right of publicity or privacy, or other right of any third party. As between you and Dcast, you bear sole responsibility and liability for your content and for your compliance with all applicable laws and with the acceptable use policy of every payment gateway you connect.
### 3.2 Content Standards All monetized content must comply with:
- Dcast's [Terms of Service](/legal/terms-of-service) - Dcast's [Community Guidelines](/legal/community-guidelines) - All applicable local, state, national, and international laws - The acceptable use policy of your connected payout gateway - Third-party intellectual property rights
### 3.3 Prohibited Content You agree not to monetize content that:
- Violates any applicable laws or regulations - Infringes on intellectual property rights - Contains illegal, harmful, or objectionable material - Promotes violence, hate speech, or discrimination - Contains explicit sexual material involving minors - Promotes fraud, scams, or deceptive practices - Violates our Community Guidelines
This prohibition — including the bar on pornographic or sexually explicit adult content and on anything on Stripe's [Restricted Businesses](https://stripe.com/legal/restricted-businesses) list or otherwise prohibited by the card networks (see our [Community Guidelines](/legal/community-guidelines), §2.7) — applies equally to content distributed or monetized through the API, embed tools, or on your external or declared domains. It is not limited to pages hosted on Dcast.
- Platform fees are automatically deducted from payments - Fees vary by subscription plan - Current fees are displayed in your dashboard
### 4.2 Creator Revenue Your sale proceeds settle directly to your connected payout gateway account; Dcast does not hold or custody your funds:
- Payouts are controlled by your connected gateway on its own schedule - Dcast is not responsible for your gateway's payment delays - You are responsible for tax obligations in your jurisdiction
### 4.3 Refunds and Chargebacks - You are responsible for handling refunds and chargebacks - Dcast may assist with disputes but is not liable for outcomes - Your connected payout gateway handles payment disputes according to its own policies (note that cryptocurrency transactions are generally irreversible and not subject to chargebacks). ## 5. Account Management
### 5.1 Payout Gateway Account Requirements You must:
- Maintain a valid account with a supported payout gateway (Stripe, PayPal, plata by mono, or cryptocurrency via NOWPayments) - Complete your gateway's verification process - Keep your gateway account information up to date - Comply with your gateway's ongoing requirements
### 5.2 Suspension of Monetization Dcast may suspend your monetization features if:
- You violate this Agreement or our Terms of Service - Your connected payout gateway account is suspended or terminated - You engage in fraudulent or harmful activities - Legal action is required
### 5.3 Termination Dcast may terminate your monetization features if:
- You repeatedly violate this Agreement - You engage in serious violations of our Terms of Service - Your connected payout gateway account is permanently terminated - Legal action is required

## 6. Intellectual Property
### 6.1 Your Content You retain ownership of all content you monetize, subject to the licenses granted in our Terms of Service.
### 6.2 Dcast Rights Dcast retains all rights to:
- The Dcast platform and services - Dcast trademarks, logos, and branding - Platform infrastructure and technology

## 7. Indemnification
You agree to indemnify, defend, and hold harmless Dcast, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
- Your use of monetization features - Content you monetize - Your violation of this Agreement or our Terms of Service - Your violation of any third-party rights - Payment disputes, refunds, or chargebacks

## 8. Disclaimer of Warranties
DCAST PROVIDES MONETIZATION FEATURES ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE DO NOT GUARANTEE THAT PAYMENTS WILL BE PROCESSED WITHOUT ERRORS, THAT YOUR CONNECTED PAYOUT GATEWAY (STRIPE, PAYPAL, PLATA BY MONO, OR CRYPTOCURRENCY) WILL ACCEPT YOUR ACCOUNT, OR THAT YOUR MONETIZATION FEATURES WILL BE UNINTERRUPTED.

## 9. Limitation of Liability
IN NO EVENT SHALL DCAST BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF MONETIZATION FEATURES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

## 10. Changes to This Agreement
Dcast reserves the right to modify this Agreement at any time. We will notify you of any material changes by posting the updated Agreement on our website. Your continued use of monetization features after such modifications constitutes your acceptance of the updated Agreement.
