dcast Video On Demand Viewer Agreement

This Video On Demand Viewer Agreement ("Viewer Agreement") is an integral part of dcast's Terms of Service and governs your access to, viewing of, and acquisition of content through dcast's video monetization platform. By purchasing, renting, subscribing to, or accessing any content on dcast, you agree to be bound by this Viewer Agreement.

If you do not agree with this Viewer Agreement, please do not purchase, rent, subscribe to, or access content on dcast.


1. Title-by-Title Viewing and Purchases

1.1 Purchase Options

You have the option to purchase videos on a per-title basis through the following arrangements:

  • Rental: Stream a video for a specified rental period (as indicated at the time of purchase)
  • Purchase: Buy permanent access to a video (subject to availability on our servers)
  • Pay-Per-View (PPV): One-time access to live or pre-recorded content

All purchases are subject to a one-time fee (shown at the point of purchase), plus any applicable taxes, fees, or charges.

1.2 Rental Rights

By choosing to "rent" a video, you gain the right to:

  • Stream the video an unlimited number of times during the specified rental period
  • Access the video from any compatible device associated with your account
  • The rental period begins immediately upon purchase and is clearly indicated at the time of purchase

Once the rental period expires, you will no longer have access to the video unless you purchase it again.

1.3 Purchase Rights

By choosing to "buy" a video, you will have the right to:

  • Watch the video an unlimited number of times for as long as it remains available on dcast servers
  • Access the video from any compatible device associated with your account
  • Download the video file (if permitted by the content creator) and retain a single copy for personal, non-commercial use

Important: Download rights are subject to the content creator's preferences and may not be available for all content. Downloaded content must be used in accordance with this Agreement and may be subject to digital rights management (DRM) protection.

1.4 Pay-Per-View Access

For pay-per-view content (including live events and exclusive releases):

  • You receive one-time access to view the content
  • Access may be time-limited or event-specific
  • Replay access (if available) will be clearly indicated at the time of purchase
  • Live event access is subject to the event schedule and technical availability

2. Subscriptions

2.1 Subscription Purchase

Premium subscriptions to creator channels, content series, or membership tiers can be purchased for a recurring fee (displayed at the time of purchase). Subscription benefits include:

  • Access to all available videos within the subscribed channel or tier
  • Access to exclusive content available only to subscribers
  • Early access to new content releases
  • Additional benefits as specified by the content creator

Once the initial subscription fee is paid, you can watch all available videos within that subscription throughout your subscription period.

2.2 Subscription Tiers

Content creators may offer multiple subscription tiers with different:

  • Pricing levels
  • Content access levels
  • Exclusive benefits and features
  • Subscription periods (monthly, annual, or custom)

You can upgrade or downgrade your subscription tier at any time, subject to the creator's subscription terms.

2.3 Automatic Renewal

Your subscription will automatically renew for the same duration as your initial subscription period (e.g., monthly, annually) unless you opt to cancel automatic renewal.

Renewal Terms:

  • The subscription fee (plus any applicable taxes) will be charged to your chosen payment method at the beginning of each renewal period
  • You will be notified in advance of upcoming renewals (as required by applicable law)
  • You can cancel automatic renewal at any time through your account settings
  • Cancellation takes effect at the end of your current subscription period
  • You will continue to have access to subscription content until the end of your paid period

2.4 Subscription Cancellation

You may cancel your subscription at any time by:

  • Accessing your account settings on dcast
  • Navigating to your subscriptions management page
  • Selecting the subscription you wish to cancel
  • Following the cancellation instructions

Cancellation Effects:

  • Your subscription will not renew after the current period
  • You will retain access to subscription content until the end of your paid period
  • No refunds will be issued for the remaining subscription period (unless required by law)
  • You may resubscribe at any time

2.5 Subscription Changes

Content creators may:

  • Add or remove content from subscription tiers
  • Modify subscription pricing (with advance notice)
  • Change subscription benefits and features
  • Discontinue subscription tiers (existing subscribers will be notified)

You will be notified of any material changes to your subscription that affect pricing or access.


3. Viewing Restrictions and Usage Rights

3.1 Personal Use Only

You may watch videos you have acquired (via "rent," "buy," subscription, or pay-per-view) strictly for personal, non-commercial viewing purposes. This means:

  • Permitted: Watching content for your personal entertainment and education
  • Permitted: Sharing your viewing experience through social media (without reproducing the content)
  • Not Permitted: Any commercial use, public performance, or redistribution

3.2 Prohibited Activities

You are expressly prohibited from:

(a) Transmission and Distribution:

  • Transmitting, broadcasting, or distributing any video through any means, including but not limited to:
    • Internet streaming or sharing
    • File sharing networks
    • Peer-to-peer networks
    • Social media platforms (except as permitted)
    • Email or messaging services

(b) Public Exhibition:

  • Publicly exhibiting, performing, or displaying any video, including:
    • Public screenings or showings
    • Commercial establishments
    • Educational institutions (without proper licensing)
    • Any public venue or gathering

(c) Resale and Commercial Use:

  • Reselling views, access, or rights to any video
  • Using content for commercial purposes
  • Creating derivative works based on the content
  • Using content in advertising or marketing materials

(d) Account Sharing:

  • Granting others access to your dcast account for the purpose of watching videos
  • Sharing your account credentials
  • Allowing multiple simultaneous streams beyond the limits specified in your subscription plan
  • Circumventing access controls or technical protection measures

3.3 Digital Rights Management (DRM)

Some content may be protected by DRM technologies. You agree not to:

  • Circumvent, disable, or interfere with DRM protection
  • Remove or alter DRM or copyright notices
  • Use tools or software designed to bypass content protection
  • Attempt to extract or copy protected content

3.4 Download Restrictions

If download is permitted for purchased content:

  • You may download and retain a single copy for personal use only
  • Downloaded content may be subject to DRM protection
  • You may not share, distribute, or transfer downloaded files
  • Downloaded content remains subject to all viewing restrictions
  • You are responsible for securing downloaded content

4. Content Availability

4.1 "As-Available" Basis

Videos are provided on an "as-available" basis. dcast does not guarantee that any particular video will remain available for streaming or download after purchase. Factors affecting availability include:

  • Content creator's decision to remove content
  • Licensing agreements and expiration
  • Technical issues or maintenance
  • Legal or regulatory requirements
  • Platform changes or discontinuation

4.2 Content Removal

If, for any reason, a video becomes unavailable, dcast may, without penalty or liability:

  • Remove the video from the platform
  • Reduce the time available to stream that video
  • Replace the video with an alternative version (if available)
  • Issue refunds at dcast's sole discretion (for recently purchased content)

dcast will make reasonable efforts to notify you if content you have purchased becomes unavailable, but is not obligated to do so.

4.3 Format Availability

The availability of videos in different formats (e.g., SD, HD, 4K, 8K, HDR) depends on:

  • Your Device: Device capabilities and compatibility
  • Internet Connection: Bandwidth and connection quality
  • Content Creator: Formats made available by the creator
  • Subscription Plan: Format access based on your subscription tier

dcast uses adaptive streaming technology to provide the best quality available based on your connection and device capabilities.

4.4 Device and Territory Restrictions

Certain videos may not be accessible for viewing on:

  • All Devices: Some content may be restricted to specific device types or platforms
  • All Territories: Geographic restrictions may apply based on licensing agreements
  • All Formats: Format availability may vary by region or device

You are responsible for ensuring that your device and location are compatible with the content you wish to access.

4.5 Account-Based Access

Titles are exclusively available to purchasers through their dcast account. To stream purchased videos, you must:

  • Maintain your account in good standing
  • Comply with dcast's Terms of Service
  • Keep your account credentials secure
  • Not violate any platform policies

Account Deletion:

  • If your account is deleted, you will lose the ability to watch purchased videos
  • Under no circumstances will viewing privileges be transferred to other accounts or platforms
  • Refunds will not be issued for content access lost due to account deletion (unless required by law)

4.6 Simultaneous Streaming Limits

Your subscription plan may limit the number of simultaneous streams. Exceeding these limits may result in:

  • Temporary suspension of streaming access
  • Requirement to close other active streams
  • Potential account restrictions

5. Refund Policy

5.1 General Policy

All purchases are considered final and non-refundable, except as required by applicable law or as specified below. This policy applies to:

  • Individual video purchases (rentals and purchases)
  • Subscription fees
  • Pay-per-view purchases
  • Donations

5.2 No Refunds For

Refunds will not be issued for:

  • Partial subscription periods
  • Unwatched videos
  • Change of mind or dissatisfaction with content
  • Technical issues resolved within a reasonable timeframe
  • Account deletion or suspension due to policy violations

5.3 Refund Eligibility

dcast reserves the right, at its sole discretion, to issue refunds in circumstances where it deems them appropriate, including but not limited to:

  • Technical Issues: Persistent technical problems preventing content access that cannot be resolved
  • Content Unavailability: Content becomes unavailable shortly after purchase (typically within 7 days)
  • Billing Errors: Duplicate charges, incorrect amounts, or unauthorized transactions
  • Legal Requirements: As required by applicable consumer protection laws
  • Exceptional Circumstances: Other circumstances determined by dcast on a case-by-case basis

5.4 Refund Process

If you believe you are eligible for a refund:

  • Contact dcast support at [email protected]
  • Provide details of your purchase and the reason for the refund request
  • Include any relevant documentation or evidence
  • Allow reasonable time for review and processing

Refund decisions are made at dcast's sole discretion and are final.

5.5 Chargebacks

If you initiate a chargeback or dispute with your payment provider:

  • Your account may be suspended pending resolution
  • You may lose access to all purchased content
  • dcast may take legal action to recover disputed amounts
  • Future purchases may be restricted

We encourage you to contact us directly to resolve any billing issues before initiating a chargeback.


6. Payment and Billing

6.1 Payment Methods

dcast accepts payments through:

  • Credit and debit cards and digital wallets, processed via the creator's connected payment gateway (Stripe, PayPal, or plata by mono (Monobank / АТ «Універсал Банк»))
  • Cryptocurrency (via NOWPayments), where supported by the creator. Note that cryptocurrency payments are generally irreversible and are not subject to chargebacks
  • Other payment methods as offered by the platform

All payments are processed securely through third-party payment processors. dcast does not store your full payment card information. For payments via plata by mono, see the Public Offer; for cryptocurrency, see our Cryptocurrency Payments Policy.

6.2 Pricing and Taxes

  • All prices are displayed at the point of purchase
  • Prices may vary by region due to currency conversion and local taxes
  • Applicable taxes (sales tax, VAT, etc.) will be added to your purchase total
  • Tax rates are determined based on your location and applicable tax laws

6.3 Billing Authorization

By making a purchase, you authorize dcast to:

  • Charge your payment method for the purchase amount
  • Charge recurring subscription fees (for subscriptions)
  • Process refunds or adjustments as applicable
  • Update payment information as needed

6.4 Failed Payments

If a payment fails:

  • You will be notified of the payment failure
  • Your access may be suspended until payment is successful
  • You may be required to update your payment method
  • dcast may attempt to retry the payment (for subscriptions)

7. Intellectual Property Rights

7.1 Content Ownership

All content available on dcast is owned by:

  • The content creators who uploaded it
  • Their licensors or assignees
  • dcast (for dcast-produced content)

You do not acquire any ownership rights in the content by purchasing, renting, or subscribing to it.

7.2 Reserved Rights

All rights not expressly granted in this Viewer Agreement are reserved by:

  • dcast
  • Content creators
  • Their respective licensors

This includes, but is not limited to:

  • Reproduction rights (beyond personal viewing)
  • Distribution rights
  • Public performance rights
  • Derivative work rights
  • Commercial use rights

7.3 Copyright Protection

Content on dcast is protected by copyright and other intellectual property laws. Unauthorized use may result in:

  • Legal action
  • Account termination
  • Civil and criminal penalties
  • Liability for damages

8. Technical Requirements and Support

8.1 System Requirements

To access and view content on dcast, you need:

  • A compatible device (computer, mobile device, smart TV, etc.)
  • A stable internet connection (for streaming)
  • A supported web browser or dcast mobile app
  • Sufficient bandwidth for the content quality you wish to view

8.2 Technical Support

dcast provides technical support for:

  • Account access issues
  • Payment and billing problems
  • Platform functionality
  • Content access problems

dcast does not provide support for:

  • Device-specific technical issues
  • Internet connection problems
  • Third-party software or hardware compatibility
  • Content quality or creative decisions

8.3 Service Availability

dcast strives to provide continuous service availability but does not guarantee:

  • Uninterrupted access to the platform
  • Error-free operation
  • Availability of all features at all times
  • Compatibility with all devices or browsers

9. Account Requirements

9.1 Account Maintenance

To access purchased content, you must:

  • Maintain an active dcast account
  • Keep your account in good standing
  • Comply with dcast's Terms of Service
  • Not engage in prohibited activities

9.2 Account Security

You are responsible for:

  • Maintaining the security of your account credentials
  • Not sharing your account with others
  • Notifying dcast immediately of any unauthorized access
  • All activities that occur under your account

9.3 Account Termination

If your account is terminated:

  • You will lose access to all purchased content
  • No refunds will be issued (unless required by law)
  • Viewing privileges cannot be transferred
  • You may be prohibited from creating a new account

10. Limitation of Liability

10.1 General Limitation

IN NO EVENT SHALL DCAST, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF DCAST SERVICES OR CONTENT, INCLUDING BUT NOT LIMITED TO:

  • Loss of access to purchased or rented content
  • Content unavailability or removal
  • Streaming interruptions or quality issues
  • Loss of subscription benefits
  • Payment processing issues
  • Account termination or suspension
  • Technical failures, system outages, or internet connectivity issues

NO LIABILITY FOR CREATOR CONDUCT OR ILLEGAL CONTENT: PURSUANT TO SECTION 230 OF THE COMMUNICATIONS DECENCY ACT (47 U.S.C. § 230), DCAST SHALL NOT BE TREATED AS THE PUBLISHER OR SPEAKER OF ANY INFORMATION PROVIDED BY CONTENT CREATORS OR USERS. DCAST SHALL NOT BE LIABLE FOR ANY CLAIMS ARISING FROM ILLEGAL, HARMFUL, OR UNLAWFUL CONTENT CREATED BY CREATORS, INCLUDING BUT NOT LIMITED TO DEFAMATION, FRAUD, OR OTHER TORTIOUS OR CRIMINAL CONDUCT. DCAST QUALIFIES FOR SAFE HARBOR PROTECTION UNDER THE DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) (17 U.S.C. § 512) AND SHALL NOT BE LIABLE FOR COPYRIGHT INFRINGEMENT CLAIMS ARISING FROM CREATOR-UPLOADED CONTENT.

COPYRIGHT DISPUTES ARE BETWEEN CREATORS AND COPYRIGHT OWNERS: DCAST DOES NOT AUTOMATICALLY REMOVE CONTENT UPON RECEIPT OF DMCA NOTICES. INSTEAD, DCAST FORWARDS DMCA NOTICES TO CONTENT CREATORS, WHO ARE RESPONSIBLE FOR RESOLVING COPYRIGHT DISPUTES DIRECTLY WITH COPYRIGHT OWNERS. DCAST IS NOT RESPONSIBLE FOR RESOLVING COPYRIGHT DISPUTES AND SHALL NOT BE LIABLE FOR ANY CLAIMS ARISING FROM COPYRIGHT DISPUTES BETWEEN CREATORS AND COPYRIGHT OWNERS. COPYRIGHT DISPUTES ARE LEGAL MATTERS TO BE RESOLVED DIRECTLY BETWEEN THE PARTIES, THROUGH NEGOTIATION, OR THROUGH THE COURT SYSTEM.

10.2 Third-Party Service Providers

DCAST USES THIRD-PARTY SERVICE PROVIDERS FOR INFRASTRUCTURE, HOSTING, CDN, PAYMENT PROCESSING, AND CONTENT DELIVERY. DCAST SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR ISSUES ARISING FROM:

  • Infrastructure Providers: Failures, outages, or issues with cloud hosting providers, data centers, or server infrastructure
  • CDN Providers: Content delivery network failures, latency issues, or service interruptions affecting video streaming or download
  • Payment Processors: Payment processing failures, delays, or issues with Stripe, PayPal, plata by mono (Monobank / АТ «Універсал Банк»), NOWPayments (cryptocurrency), or other payment providers
  • Network Providers: Internet service provider outages, network congestion, or connectivity issues preventing content access
  • Streaming Infrastructure: Failures of streaming protocols, video players, or third-party streaming services
  • Any other third-party service: Failures or issues with any service provided by third parties that dcast relies upon

DCAST ACTS AS AN INTERMEDIARY PLATFORM AND DOES NOT CONTROL, OPERATE, OR MAINTAIN THE UNDERLYING INFRASTRUCTURE PROVIDED BY THIRD PARTIES. YOU ACKNOWLEDGE THAT DCAST CANNOT BE HELD RESPONSIBLE FOR ISSUES BEYOND ITS DIRECT CONTROL, INCLUDING THIRD-PARTY PROVIDER FAILURES, NETWORK OUTAGES, OR INFRASTRUCTURE PROBLEMS THAT PREVENT CONTENT ACCESS.

10.3 Content Availability

DCAST SHALL NOT BE LIABLE FOR:

  • Content Removal: Loss of access to content due to creator removal, licensing expiration, or legal requirements
  • Streaming Issues: Interruptions, buffering, or quality issues caused by network problems, CDN failures, or third-party infrastructure issues
  • Format Unavailability: Inability to access content in specific formats due to device limitations, network bandwidth, or third-party service restrictions
  • Geographic Restrictions: Content unavailability due to licensing restrictions or third-party geographic limitations

10.4 Exclusions

DCAST SHALL NOT BE LIABLE FOR DAMAGES THAT ARE:

  • CAUSED BY THIRD-PARTY SERVICE PROVIDERS BEYOND DCAST'S REASONABLE CONTROL
  • THE RESULT OF FORCE MAJEURE EVENTS (AS DEFINED IN SECTION 10.5)
  • CAUSED BY YOUR FAILURE TO COMPLY WITH THIS AGREEMENT
  • THE RESULT OF UNAUTHORIZED ACCESS TO YOUR ACCOUNT
  • CAUSED BY YOUR DEVICE, NETWORK, OR INTERNET CONNECTION ISSUES
  • RESULTING FROM CONTENT CREATOR ACTIONS OR DECISIONS
  • RESULTING FROM TECHNICAL FAILURES, SYSTEM OUTAGES, OR INTERNET CONNECTIVITY PROBLEMS
  • ARISING FROM ILLEGAL ACTIVITIES, COPYRIGHT INFRINGEMENT, OR OTHER UNLAWFUL CONDUCT BY CONTENT CREATORS
  • RESULTING FROM CONTENT REMOVAL DUE TO COPYRIGHT CLAIMS, LEGAL REQUIREMENTS, OR VIOLATIONS OF APPLICABLE LAWS

10.5 Force Majeure

DCAST SHALL NOT BE LIABLE FOR ANY FAILURE OR DELAY IN PROVIDING CONTENT ACCESS THAT IS DUE TO FORCE MAJEURE, INCLUDING BUT NOT LIMITED TO:

  • Natural disasters, earthquakes, floods, fires, or other acts of nature
  • War, terrorism, civil unrest, or acts of government
  • Pandemics, epidemics, or public health emergencies
  • Strikes, labor disputes, or work stoppages
  • Cyberattacks, security breaches, or distributed denial-of-service attacks
  • Failures of third-party infrastructure, networks, or services
  • Changes in laws, regulations, or government policies
  • Power outages, telecommunications failures, or internet disruptions
  • Internet service provider outages, network congestion, or connectivity issues
  • Technical failures, hardware malfunctions, or software bugs
  • Data center outages or infrastructure failures
  • Third-party provider service interruptions or terminations
  • Any other circumstances beyond dcast's reasonable control

DURING FORCE MAJEURE EVENTS, DCAST WILL USE COMMERCIALLY REASONABLE EFFORTS TO RESUME CONTENT ACCESS AS SOON AS PRACTICABLE, BUT SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR FINANCIAL HARM RESULTING FROM SUCH EVENTS, INCLUDING BUT NOT LIMITED TO LOST ACCESS TO PURCHASED CONTENT, REFUNDS, OR COMPENSATION FOR INTERRUPTED VIEWING.

10.6 Jurisdictional Limitations

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, DCAST'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.


11. Changes to This Agreement

dcast reserves the right to modify this Viewer Agreement at any time. We will notify you of any material changes by:

  • Posting the updated Agreement on our website
  • Updating the "Last Updated" date
  • Sending an email notification (for significant changes)
  • Displaying a notice on our Services (for major changes)

Your continued use of dcast Services after such modifications constitutes your acceptance of the updated Viewer Agreement. If you do not agree to the modified Agreement, you must stop using dcast Services and may cancel your account.


12. Dispute Resolution

11.1 Contact Us First

Before filing a claim, you agree to contact dcast at [email protected] to attempt to resolve any disputes informally.

11.2 Governing Law

This Viewer Agreement shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

11.3 Dispute Process

Any disputes arising out of or relating to this Viewer Agreement or your use of dcast Services shall be resolved in accordance with dcast's Terms of Service dispute resolution provisions.
